We recently have experienced a somewhat high volume of questions regarding the ESIGN ACT and the GoCanvas service's compliance with certain provisions of the ESIGN ACT.
Passed in June 2000, the Electronic Signatures in Global and National Commerce Act (the ESIGN ACT) provides guidelines and compliance protocols so that commercial entities and customers may rely on electronic signatures to memorializes acceptance of commercial terms. Although there are numerous provisions (see https://www.gpo.gov/fdsys/pkg/PLAW-106publ229/pdf/PLAW-106publ229.pdf), the main provisions require that (a) the consumer consents to using electronic signatures, (b) the entity retains documents consumers have signed so that they may be reviewed, and (c) that changes in access to previously signed documents not be impaired by changes to hardware or software without adequate and reasonable notice.
The GoCanvas platform provides uninterrupted document retention for validly licensed subscribers to the platform. When used as designed, the GoCanvas service can form a component of an ESIGN-compliant service.
